IEBC dismisses election malpractice claims. The Independent Electoral and Boundaries Commission (IEBC) has strongly criticized recent political claims of election malpractice. The Commission labeled the remarks as reckless, misleading, and damaging to Kenya’s democracy.
In a Sunday statement, IEBC warned that making such claims outside an election period stirs public anxiety and weakens trust in electoral institutions. The Commission urged leaders to act responsibly and avoid spreading unfounded allegations.
The IEBC clarified it has not announced any elections, and Kenya is not in a campaign period. Therefore, it emphasized that no legal or constitutional grounds exist for political propaganda or election-related rhetoric.
The Commission added that it can only activate its Electoral Code of Conduct Enforcement Committee during an official election period. This authority stems from Article 84 of the Constitution and Section 110 of the Elections Act.
Citing a 2022 Supreme Court ruling in the Sabina Chege case (E026 of 2022), IEBC explained that its enforcement powers are limited when no election has been declared.
Despite the restrictions, the Commission expressed its readiness to work with political leaders and stakeholders. It aims to rebuild public trust in the electoral system now that it is fully reconstituted.
The IEBC urged all stakeholders especially political leaders to avoid making statements or taking actions that weaken public trust in the electoral process. Instead, the Commission called for collective efforts to promote transparency, accountability, and national stability.
It also reaffirmed its independence and neutrality in handling its constitutional duties. The Commission emphasized its strong commitment to conducting free, fair, and credible elections, in line with the law and international standards.
